For companies that operate on an international scale that are looking to protect their innovation in different countries the international processing of applications within the framework of the Patent Cooperation Treaty (PCT) is a very attractive option since it makes it possible to use one application to seek protection in more than 150 countries.
Managed by the World Intellectual Property Organization (WIPO), this is a centralized, economical and efficient system.
WHY IS AN INTERESTING OPTION TO APPLY THROUGH THE PCT SYSTEM?
The applicant has up to 30 months to decide in which member countries of the PCT system he/she wishes to protect. It grants the applicant a provisional 30-month protection and the costs associated with entering the national phase once the countries in which protection is required have been chosen.
It allows companies to "test" the potential of the market during two and a half years and to evaluate the "state of the art" of the invention. The applicant receives an international search report and a preliminary report regarding the patentability in the different countries of interest.
